Manisha Marwaha represents the Secretary of State for the Home Department in International Adoption Proceedings

In adoption proceedings with an international dimension Manisha Marwaha represented and successfully advised the Secretary of State for the Home Department (SSHD), in proceedings heard before Mr Justice Cobb, where the SSHD sought to intervene and oppose an adoption application.

Proceedings involved the entry of a minor into the UK on a visit visa and an adoption application being made in England and Wales prior to the minor’s 18th birthday. It was contended that the adoption application was misused to gain a right of abode and undermine immigration policies and procedures.

Manisha successfully advised and represented the SSHD in this complex matter in respect of both family and immigration law. Manisha advised on disclosure requirements and the correct application and relevant provisions of both the British Nationality Act 1985 and the Adoptions with a Foreign Element Regulations (AFER) 2005 in order to provide an effective and pragmatic response to the presented application.
