Eugene was instructed by the CPS to prosecute a man alleged to have broken in through the window of his former partner’s flat and strangled her multiple times whilst her toddler was in the room. Whilst giving evidence, the complainant became mute, unable to answer any questions due to the stress of giving evidence. After a break, the complainant said that they were not willing to return to the courtroom. Eugene applied to vary the complainant’s special measures so that they could give evidence over a live link. The application, which was opposed, was to ensure that the complainant could continue to give her best evidence. The complainant gave the remainder of their evidence over live-link and the Defendant was convicted on 2 counts of strangulation and 1 count of battery. The Defendant will be sentenced in April.
