Joseph regularly accepts instructions to advise and represent Claimants and Defendants in personal injury and road traffic accident claims, insolvency proceedings, contractual disputes and claims for compensation under EC Regulations.

Joseph has a particular expertise in occupational deafness/tinnitus claims, having appeared in widely circulated cases such as Lomas v London Electric Wire Company & Smiths Ltd.

Practice Summary

Joseph specialises in industrial disease litigation and has successfully represented Claimants in actions for noise induced hearing loss/tinnitus, HAVS/vibration white finger, asbestosis/respiratory disease and occupational cancer.

He has a nationwide occupational illness practice and prides himself on working closely with his instructing solicitors at all stages of litigation in order to secure the best possible result for his client. Has extensive experience of Fast Track and Multi Track litigation.

Joseph was the co author of the Diagnosis, Limitation and Quantum chapters of the 2016 APIL Guide to Noise Claims and has delivered seminars/training in relation to issues of causation/de minimis in such claims.

  • Inquests into fatal accidents in a clinical/care setting;
  • Ophthalmic injuries.

Has appeared in applications and variation hearings in relation to Football Banning Orders (FBOs), Antisocial Behaviour Orders (ASBOs), Restraining Orders and Sexual Offences Prevention Orders (SOPOs).

Has experience drafting, advising and representing Police Forces in civil actions against the police for negligence, misfeasance, and has a particular interest in claims involving breaches of the Data Protection Act by the police.

Co-author of numerous articles including Westlaw Insight’s “Police Negligence” commentary.
