Adam Keenaghan appeared in the Court of Appeal on behalf of two defendants last week, successfully arguing that their sentences of immediate custody should be quashed and substituted with Suspended Sentence Orders.
In June this year, the defendants were sentenced to immediate custody at the Sheffield Crown Court for money laundering offences. Each Defendant had pleaded guilty to offences of money laundering related to frauds committed against HMRC by a number of other individuals.
Allowing the appeal, the Court of Appeal found the defendants had strong personal mitigation and commented that the sentencing principle which the sentencing judge had in mind when imposing immediate custody had “fallen out of favour”.
